1. TERMS OF SERVICE

IWF Bologna provides free access to its website www.iwfbologna.com (the “Website“) and a series of services (the “Services“), hosted on the Website and on the forum www.iwfbolognachat.org (the “Forum“), with the aim to found and maintain an online community of women coming from different countries, who live in or have a connection with Bologna.

Here follow the Website and Forum’s terms of service (the “Terms of Service“), which will be considered implicitly accepted if you use our Services or visit the Website.

IWF Bologna reserves the right to modify, add or delete, some or all of the provisions herein, even without prior notice. The new Terms of Service will be published in this section of the Website. Each user is obliged to check periodically if the Terms of Service herein have changed since their previous visit to the Website.
If you do not agree with the Terms of Service, you can delete your account at any time by sending a request to membership@iwfbologna.com, or a registered mail to International Women’s Forum of Bologna, at its registered office in Bologna, via del Piombo no. 5. In any case, if you keep using our Services, the new Terms of Service will be considered implicitly accepted.
IWF Bologna accepts no responsibility nor liability whatsoever with regard to the Services provided. IWF Bologna expressly reserves the right to modify, suspend and terminate the Services, even partially, including access to the database and other material. Therefore, IWF Bologna shall not be liable for any damage suffered by the users due to any disruption of the Services, which may be caused, for example, by planned or supplementary maintenance work of the Website or the Forum.

Likewise, IWF Bologna shall not be liable for any damage due to events beyond its reasonable control, including but not limited to acts of God, strikes, fire, floods, government orders, events attributable to any third party which can prevent, directly or indirectly, access to the Website, Forum and related Services.

1.1 ACCESS TO SERVICES

The Services offered by IWF Bologna must be used exclusively for private purposes. No material or information extracted from the Website or the Forum may be used or exploited for any purpose different from those set out herein without the prior consent of the user who uploaded it.

The Services are provided through the Internet. It is up to you to check if your Internet connection, hardware and software are suitable in order to use the Services. IWF Bologna shall not be liable for any hardware or software malfunction which makes access to the Services more difficult, discontinuous or impossible.

1.2 FORUM

Registered users can use the Forum to post their content, without prejudice to any third party’s rights, and on condition that the content is not offensive, illegal or libellous in any way. IWF Bologna does not perform any preventive control over the content posted by the users, who are solely responsible for their own content and the consequences of posting or publishing it.

Therefore, you are fully responsible for the content you post or publish, and you declare to have the intellectual property right of that content, or you are entitled to use it in that manner.

IWF Bologna does not verify the truthfulness and the legality of the content published by the users.

If you believe that someone else’s content is infringing on your copyrights or is offensive, inappropriate, obscene or unlawful in any way, you may report any abuse to our Website’s administrators by e-mail to the address membership@iwfbologna.com. The administrators will promptly intervene and, if needed, will report the abuse to the competent Authority.
Each user agrees to indemnify and hold IWF Bologna harmless against any claim concerning the content posted or published by users.

1.3 JOB BANK

The Forum contains the section “Job Bank”, where the user can post job offers and requests, which will be visible only to registered users. IWF Bologna is not a job agency, it only provides the hosting services for the content posted by the users, without offering any job mediation service.

1.4 LOGIN INFORMATION

If you are a registered user on IWF Bologna Website or Forum, you are required to keep any personal login information safe and strictly confidential, so that IWF Bologna will not be responsible for any loss or damage resulting from use of your login information by any third party. You may not communicate or assign your login credentials to any third party. In case of theft, loss or compromise of your login information, you must promptly report it to IWF Bologna, writing to membership@iwfbologna.com. In any case, you agree to indemnify and hold IWF Bologna harmless from any and all claims that may be made against it in relation to improper use of your login information. After receiving the mentioned communication, IWF Bologna will disable your current password and send a new one to your e-mail address.

1.5 INTELLECTUAL PROPERTY RIGHTS AND LINKS

Unless otherwise provided for, and with the exception of the content posted or published by the users, IWF Bologna has the exclusive intellectual property of all the Website’s and the Forum’s materials, which are protected by copyright pursuant to the Italian Act no. 633/1941.

Therefore, you cannot perform any action that infringes or violates the Website or Forum’s copyrights, including but not limited to the following:

(i) duplicate on any support transform, rephrase, translate, adapt, modify, temporarily or permanently, in whole or in part, by any means and in any form;
(ii) load, display, publish, broadcast to the public, transfer or save, by any means, Internet included;
(iii) sell, license, sub-license, transfer or make available to any third party, in any way or by any means, in return for payment or free of charge;
(iv) use or make copies for advertising, promotion or commercial purposes or any other purpose different from surfing the Website or using the Services;

Any derogation from the Terms of Services herein must be expressly approved in writing by IWF Bologna. Nonetheless, every authorized operation must pursue a legitimate aim and comply with the law.

2. PRIVACY POLICY

Your Privacy is very important to the IWF Bologna. Accordingly, your personal data will be collected and processed only to the extent strictly necessary to offer our Services and let you join our community. In any case, your data will be collected and processed in compliance with the provisions of the General Data Protection Regulation 2016 (hereinafter “GDPR”), within the terms below. The Website and the Forum may include links to other websites, whose content is not under our control. Therefore, if you choose to visit those websites, we recommend that you check their privacy policy.

2.1 DEFINITIONS

Personal Data is any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as name, an identification number, location, data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing means any operation, or set of operations, which is performed on personal data, or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State Law, the controller, or the specific criteria for its nomination, may be provided for by Union or Member State Law.

2.2 DATA CONTROLLER

This Privacy Policy deals with the Data Processing carried out by IWF Bologna, and it is therefore IWF Bologna who qualifies as data controller in respect of your personal data.

2.3 DATA PROCESSOR

Taking into account the limits related to the process purposes, the Data may be communicated by IWF to partners, consultants, private companies event planning agencies, suppliers of any kind of services (booking for museum, restaurant, etc.), legal and financial advisors, companies or consultants whose tasks consist of installing, maintaining and upgrading the Website, individuals who must be allowed access to personal data according to and/or under enforcement of laws, administrative acts and court decisions, who are nominated Processors by the Data Controller either for law requirement or for the accomplishment of Your specific requests. Your data are not going to be diffused. The details of the Processors and the subjects authorized by IWF Bologna are available in a periodically updated list at membership@iwfbologna.com

2.4 DESIGNATION OF DATA PROTECTION OFFICER (DPO)

A defined role of Data Protection Officer (DPO) is required, pursuant to art. 37 of the GDPR and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, if an organisation is a public authority, if it performs large scale monitoring or if it processes particularly sensitive types of data on a large scale. The DPO is required to have an appropriate level of knowledge and can either be an in-house resource or outsourced to an appropriate service provider.

Based on this criteria, IWF Bologna does not need to appoint a DPO.

2.5 GENERAL PRINCIPLES OF THE DATA PROCESSING

Personal data shall be:

  1. Processed lawfully, fairly and in a transparent manner in relation to the data subject, on the basis of appropriate legal grounds (“lawfulness, fairness and transparency”);
  2. Collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall, in accordance to art. 89, par, 1, of the GDPR, not be considered incompatible with the initial purposes (“purpose limitation”).
  3. Adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed (“data minimisation”);
  4. Accurate and, where necessary, kept up-to-date; every reasonable step must be taken to ensure that personal data that is inaccurate, having regard to the purposes for which it is processed, is erased or rectified without delay (“accuracy”);
  5. Kept in a form which allows identification of data subjects for no longer than is necessary for the purposes for which the personal data is processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes in accordance with art. 89, par. 1, of the GDPR, subject to implementation of the appropriate technical and organisational measures required by this Regulation in order to safeguard the rights and freedoms of the data subject (“storage limitation”);
  6. Processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction and damage, using appropriate technical or organisational measures (“integrity and confidentiality”).

The controller shall be responsible for, and be able to demonstrate compliance with, paragraph 1 (“accountability”).

2.6 LEGAL BASIS OF THE DATA PROCESSING

Processing shall only be lawful if at least one of the following applies:

  1. The data subject has given consent to the processing of his or her personal data for one or more specific purposes – i.e. if consent has been signed or given by electronic means (pressing consent button or link or giving consent over recorder telephone etc.).
  2. Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract – i.e. the processing is necessary in order to apply the Association’s statute. Please note that in such a case your separate consent is not required, and your data is processed as long and to the extent required for the performance of the contract.
  3. Processing is necessary for compliance with a legal obligation to which the controller is subject – i.e. in case UE or a national piece of legislation prescribes for IWF Bologna to process your data. Please note that in such case also your separate consent is not required, and your data is processed as long and to the extent as required to the performance of the contract.
  4. Processing is necessary in order to protect the vital interests of the data subject or of another natural person.
  5. Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
  6. Processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular, when the data subject is a child.

On the basis of the background information, the legitimate interest shall always be subject to a balance of interests test. IWF Bologna makes sure to consider any potential impact on you (both positive and negative) and your rights before processing your personal data in its legitimate interest.

2.7 DATA COLLECTION AND PURPOSES

Whenever you visit the Website or the Forum, some data will be automatically collected, such as the data regarding navigation, pages visited, time of each visit and city from which you are connecting.

To do that, we run the services offered by Google Analytics, properly configured in order to partially hide your IP address and prevent your identification as much and as safely as possible.

The data will be collected in anonymous and aggregate form, which does not allow you to be identified. Such data will show us the global trend of visits in order to improve the Website and the Forum, their content and your navigation experience.

The Website has been developed using appropriate measures to avoid any collection of personal data during normal navigation. However, in order to use some services, such as the Forum and the Job Bank, registration is required.

During registration you will be asked to provide us with some personal information, such as your name, your e-mail address, your interests, hobbies etc.

Some of this information is necessary in order to provide you with the credentials for the login, identify you in our community and provide you with some Services, such as the Forum and the newsletter.

Other information is optional and is requested to help you join our community and introduce yourself to other members of IWF Bologna.

After registration, your profile will be visible only to registered users. Likewise, registered users can access the content you post in the Forum and in other interactive areas, such as the Job Bank. We consequently discourage you from posting any confidential information. In any case, your personal data will not be disseminated nor communicated to any third party for advertising or any other purpose, except as a result of legal obligation or authority order.

2.8 COOKIES

2.9 TRANSFER OF PERSONAL DATA

IWF Bologna does not make any transfer of personal data outside the European Union. In any case, future transfers of personal data outside the European Union will be carefully reviewed prior to the transfer, to ensure that they fall within the limits imposed by the GDPR.

This partly depends on the European Commission’s judgement about the adequacy of the safeguards for personal data applicable in the receiving country and therefore may change over time.

2.10 YOUR RIGHTS AS A DATA SUBJECT

  • Your right to access

You have the right to access your personal data, including requesting information on whether IWF Bologna processes your data, which data are processed, and you may also request a copy of the data that you or a third person provided to IWF Bologna and which data is being processed by IWF Bologna.

If you request that IWF Bologna confirms whether or not IWF Bologna processes your personal data, then you have the right that obliges IWF Bologna to confirm that it processes your personal data or does not process your personal data.

Your right to obtain confirmation whether IWF Bologna processes (or does not process) your personal data

IWF Bologna shall give you access to your personal data if

  • Your right to erasure (or “right to be forgotten”)

Subject to certain conditions and in certain cases, you have the right to the erasure of your personal data. This means that you may request that we delete your personal data that we may have processed unlawfully or where the use of your data is no longer needed for a purpose. However, IWF Bologna shall not communicate the erasure of personal data to the recipients if the communication to such recipients is either impossible or involves a disproportionate effort.

Please note that there are certain cases when you may not request erasure of your data. The reasons will be communicated to you if your request for erasure cannot be completed.

  • Your right to the restriction of processing

You may also request the restriction of the processing of your personal data. For instance, you may request that we suspend the processing of your personal data where our use of the data is unlawful, but you do not want us to delete it.

IWF Bologna shall restrict the processing of your personal data for a period, if you request to obtain such restriction of the processing of your personal data to verify and/or challenge the accuracy of such data.

IWF Bologna shall restrict the processing of your personal data upon your request to obtain such restriction due to unlawful data processing.

IWF Bologna shall restrict the processing of your personal data if

  1. you request to obtain the restriction of the processing of such data, and
  2. IWF Bologna does not need such data for the purposes of its processing, and
  3. you require your data for establishment, exercise or defence against a legal claim.

IWF Bologna shall restrict the processing of your personal data if

  1. you object to the processing of your personal data that is necessary for the purposes of the legitimate interests that IWF Bologna pursues, and
  2. you wait to verify that the legitimate ground of IWF Bologna’s processing of your personal data does not override your objection.

IWF Bologna shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to communicate the restriction of processing of your personal data to recipients of such personal data (if any). However, IWF Bologna shall not communicate such restriction to recipients if the communication to such recipients is either impossible or involves a disproportionate effort.

If IWF Bologna restricts its processing of your personal data, then it may

  1. store such personal data,
  2. process such personal data on the basis of your consent,
  3. process the personal data for establishing, exercising or defending a legal claim, or for protecting the rights of another person.

In case you have obtained restriction of processing as per the above than you shall be informed by IWF Bologna before the restriction of processing is lifted.

  • Your right to data portability

Where the processing of your data is either based on your consent or is necessary for the performance of a contract, and the processing is carried out by automated means, then you may request the provision of your personal data that you have provided to us in a standard format, and you may also request such data be transferred to another entity.

Without prejudice to your rights above, you have the right to receive the personal data concerning you, which you provided to IWF Bologna, in a structured, commonly used and machine-readable format, and you have the right to transmit those data to another controller without hindrance (where technically feasible) from IWF Bologna, where the processing is based on your consent, or is necessary for the performance of a contract, and the processing is carried out by automated means.

Your right to data portability

  • Your right to withdraw consent

Also, you have the right to withdraw your consent at any time where we rely on your consent for processing your data. You may do this at any time by contacting us at membership@iwfbologna.com. Remember that the withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal and that in some cases we may need time to process request.

IWF Bologna shall, taking account of available technology and the cost of implementation, take reasonable steps, including technical measures, to communicate your objection/withdrawal of consent to recipients of such personal data (if any). However, IWF Bologna shall not communicate such restriction to recipients if the communication to such recipients is either impossible or involves a disproportionate effort.

  • Your right to lodge a complaint

Without prejudice to any other administrative or judicial remedy that you may have (such as the right to claim compensation for damages suffered as a result of IWF Bologna’s breach of the GDPR), you have the right to lodge a complaint with the Italian Data Protection Authority (“DPA”), supervisory authority, or another data protection supervisory authority in the Member State of your habitual residence, place of work or place of the alleged infringement if you find that the processing of personal data relating to you infringes the GDPR.

2.11 RESTRICTION ON THE ABOVE RIGHTS

Please be advised that, based on GDPR, Member States are allowed to restrict by way of a legislative measure the scope of the rights you may have as per the above. In case such a restriction is applicable in your respect, we will advise you accordingly when you contact us to exercise any of your above rights.

2.12 BREACH NOTIFICATION

In line with GDPR, where a breach is known to have occurred and it is likely to result in a risk to the rights and freedoms of individuals, the relevant Data Protection Authority will be informed within 72 hours. This will be managed in accordance with our Personal Data Breach Notification Procedure which sets out the overall process of handling information security incidents.
